DAMN parents lose kids over bath-time photos-lawsuit filed against Wal-Mart

  • August 2008 couple took a memory stick with 144 pictures in to a Wal-Mart located in Perorea, Arizona
  • 8 pictures from the memory stick were of the couples “bath time photos” of the their daughters (during and after)
  • A Wal-Mart employee noticed the pictures and alerted the police who in turn began an investigation into child pornography against the couple
  • Lisa was suspended for 1 yr from teaching, children taken a way for a month, $75,000 in legal fees, and both were placed on a list for sex offenders

DAMN

  • Suing the city of Peoria for defamation
  • Suing Wal-Mart for failing to tell them that they had an “unsuitable print policy” and could turn over photos to law enforcement without their knowledge

Parents released this photo and others (other pics can be viewed on video below) to show the pictures of the girls are innocent

My DAMN Opinion:

Now there are only 4 pictures that have been released, but if they are anything like the pictures that have been released then what was done to this couple was unnecessary.  It’s hard to give an opinion with out seeing all the evidence (other 4 pictures), but from what I’ve so far the couple has a great case against the city and Wal-Mart.  The employee did the right thing by contacting authorities if this is what Wal-Mart encourages all employees to do in a situation like this, but once the authorities took a look at the photos common sense should’ve told them this wasn’t child pornography.  It’s good to ask about or know the policy of a store when having photos like this developed, but it’s just as important to use good judgment when accusing someone of a child pornography. (If you don’t you could end up with a lawsuit against your city or company). DAMN
